Terms & Conditions of Sale

These General Terms of Sale come into effect as from 16th of September 2012.

Scope and acceptance of General Terms of sale 


The site www.lesfleursdebach.com (here in after referred to as the “Site”) is published by the company Elixirs & Co (here in after referred to as the Vendor), a company registered in France under company number

The Vendor reserves the right to change these General Terms of Sale without notice and at any time, with any modifications not applying to reservations and orders already accepted and confirmed by the Customer.

These Terms of Sale shall apply to the exclusion of any other document.

User that has confirmed an order shall then be referred to as the “Customer”.


2. Products and services


All the offers of products proposed on the Site are limited to
www.lesfleursdebach.com.

Prior to placing an order, the Customer may check the main features of any product or products they wish to order, by consulting the Site.

Purchase offers, including special promotions, are valid for as long as they are visible on the Site.


3. Prices of products for sale on the Site 


The prices shown on this Site are in euros, including all taxes, and are guaranteed up to date, with it being stipulated that products ordered are invoiced at the price in force when the order is registered.

They do not include shipping charges, which are invoiced in addition to the price of the purchased products, according to the total amount of the order. Shipping charges will be shown before the Customer is asked to confirm the order.

Prices include value added tax (VAT), at the rate in force on the day of the order and any change in the applicable rate will be automatically reflected in the price of the products sold by the Vendor on its Site.

 

4. Connexions and Orders

To connect

You have 3 possibilities :

- connexion by creating an account : you have to give your "originals" contact details. If you want to delete your account, you have to send an email to serviceclient@lesfleursdebach.com

- connexion by social media : you accept the social media terms

- make an order without account : you have just to give your contact details but you won't have an account

To make an order 

All orders imply full and unreserved acceptance of these Terms of Sale. 

The Customer accepts that the Vendor's order registration systems are proof of the nature of the agreement and its date.

When the order is confirmed by clicking on the “Complete my order” button, the Customer declares that they accept the order, together with these General Terms of Sale. A summary of the order can be printed.

Once the order has been registered, a detailed acknowledgement of the order is sent to the Customer at the e-mail address provided.

This acknowledgement specifies the exact amount invoiced and details of delivery.

This acknowledgement implies acceptance of the order and confirms the transaction, subject to order payment.

In the event of one or more products being unavailable once the order has been placed, the Customer will be notified by e-mail.

The Vendor does however reserve the right to suspend or cancel any order placed by a Customer with whom a dispute exists regarding the payment of a previous order, or for any other legitimate reason, in particular related to the unusual nature of the order or if the customer does not order for his personal use but act as a wholesaler..  



5. Payments 

 
All orders are payable in euros.

To pay for their order, the Customer must use the following method of payment: bank card, Paypal or a bank cheque.

The Customer guarantees the Vendor that they have been granted any authorizations required to use their chosen method of payment, when registering the purchase order.

In the event of non-payment of any amount owed by the Customer, or of any adverse payment circumstances, the Vendor reserves the right to suspend or cancel any order and/or delivery, whatever their nature or state of progress.

To ensure secure credit card payment, the Customer must send the card security code of the bank card being used.

 

6. Order Delivery

The Products and the Gift Cards can be delivered in France métropolitaine and international.

 

Delivery time

We are engaged to deliver our products in a minimum 30 business days delay following the order confirmation.

Elixirs & Co. Offers severals services and delivery types which could shorten these times and without that Elixirs & Co. is linked to these delays.

In order to respect these deadlines, the Client have to order before 12pm and to pay by card or Paypal (in order to the available stocks).

*About the Express delivery, the delivery time will not be respected during the week-end and holiday and the day before it. If you really want to be delivered in 1 business day, you will have to order at the latest the Thursday before 12pm, by card or Paypal (in order to the available stocks).

Terms of delivery

 

COLISSIMO: DELIVERY WITHOUT SIGNATURE

The contribution to shipping cost is €7. This price applies to orders in metropolitan France only (Corsica and Monaco included) for any order of less than €30 all taxes included, shipping cost excluded.

The delivery without signature cannot be selected for orders superior or equal to €30 all taxes included, shipping cost excluded.

The customer will be able to follow his/her parcel thanks to a tracking number he / she will receive by e-mail or by asking it to the customer services.

The parcel will be directly dropped off in the mailbox to the indicated delivery address.

NB: if the mailbox is too small, the parcel can be dropped off directly to the customer or to an other person living at the indicated address (neighbour or concierge). If the parcel is dropped off to an other person, the customer should informed by the delivery services of the name and address of this person. If the customer has any request concerning the delivery, he/she will have to indicate it to the costumer services when he/she orders. 

If the parcel cannot be dropped off by any means described above, the delivery services will inform the customer that his/her parcel is waiting for them at the delivery services office. The customer will have 14 days to go get it, after this delay the parcel will be send back to us and the shipping back cost will be paid by the customer.

In case of reclamation, data given by Elixirs & Co software will be considered as right if the customer cannot prove the opposite.

COLISSIMO AGAINS SIGNATURE : DELIVERY WITH SIGNATURE

The delivery fees : 9€ for orders between 30€ and 99.99 € TTC and 10€ for all order above or equal 100€ TTC.

This delivery type is only available for France delivery.

The Colissimo againt signature can be selected only for orders under to 30€ TTC.

The Client will be able to follow his pack thanks to the traking number which the Client will receive by email or by default, by the Clients Service.

The pack will be given personally to the Client by La Poste in return for signature. The pack will be also given personnally to a third party who is mandated by the Client.

The scanned signature will be exercised pack delivery.

In case of absence, a notice of proceeding is left in your letterbox by La Poste. It will notice the Post office information. The Client can take away its pack during the delay noticed by La Poste.

If the Client doesn’t respect the delay, the pack will be removed in our warehouse and the delivery fees will be billed to the Client.

 

CHRONOPOST – EXPRESS DELIVERY

The delivery fees : 19.5€ for all orders. This delivery type is only available for France delivery.

The Client will be able to follow his pack thanks to the traking number which the Client will receive by email or by default, by the Clients Service.

The pack will be given personally to the Client by La Poste in return for signature. The pack will be also given personnally to a third party who is mandated by the Client.

The scanned signature will be exercised pack delivery.

MONDIAL RELAY

The pack is delivered in the Mondial Relay store choosed by the Client among the proposed list during the end of the order.

This delivery type is only available for France delivery.

The delivery fees : 6 € for order under 30€ TTC, 7€ for order between 30€ and 99.99 € TTC and offered for all order above or equal 100€ TTC.

As soon as the pack is available in a Mondial Relay, The Client will receive a confirmation email via Mondial Relay. His pack will be available according to the Store. In order to pick it, the Client will have to sign and to get a valid ID card.

 

CLICK & COLLECT IN ONE OF OUR 3 ELIXIRS & CO. STORES – STORE PICK UP

The pack is delivered in one of our 3 Elixirs & Co. Stores choosed by the Client among the proposed list during the end of the order.

There is no delivery fees for this delivery type.

The Client will receive a confirmation email as soon as his order will be available in store. His pack will be available during 14 calendary days. In order to pick it, the Client will have to present the email (printed or via the smartphone) and a valid ID card.

The Customer has a period of 14 clear days as from the date of reception, to return the ordered products at their own expense for reimbursement. 

The reimbursement will be made by any method of payment that the Customer has chosen after exercising their right of withdrawal, no later than 14 days following the date on which the right was exercised

 

7. Right of withdrawal


The right of withdrawal does not apply on customized elixirs.

The Customer has a period of 14 clear days as from the date of reception, to return the ordered products (even products on sales) at their own expense for reimbursement. 

The  product must be returned in good shape in the original packaging to Elixirs & Co: 53 rue des Batignolles 75017 PARIS - FRANCE

We cannot accept items back that have been opened or used unless the product is damaged or defective.

This policy is only applicable to purchases made online at www.clarins.lesfleursdebach.com; we are unable to process returns for purchases made from any other outlet.

 

8. Liability


The Vendor cannot be held liable for non-fulfilment of contracts due to stock shortages or in the event of product unavailability due to force majeure. 

The Vendor accepts no liability for any interruption to the Site, any incidences involving bugs, any damage resulting from a fraudulent intrusion by a third party, causing any change to the information made available on the Site and  more generally, any direct or indirect damage, whatever the cause, origin, nature or consequences, including in particular any loss of profit, customers, data or any other loss of intangible goods that may occur as a result of the access by any person to the Site or the impossibility of accessing the Site or any credit accorded to any information directly or indirectly coming from it.

 

The vendor is not responsible for any improper use of a product that may cause problems or injuries.



9. Returns


If for any reason you are not entirely satisfied, you may return any item in its original condition for a full refund or a replacement within 7 days from delivery accompanied by the return filled form..

The Vendor will answer as soon as possible. The vendor could ask more information or pictures of the product.

For a return please send your products with your return form to:

You require a full refund of your order because of product damaged, faulty texture, , wrong product shipped, faulty device/container product  etc… please send us back your products within 7 days of  delivery . We will give you a full refund, including the delivery costs - provided that you have returned the goods to us in their original condition.

11. Data processing and Civil liberties


According to the legislation  on the protection of individuals with regard to the processing of personal data and on the free movement of such data, all participants have the right to access, correct and even delete personal information.

This right may be exercised by sending a request to the following e-mail address: Elixirs & Co – 53 rue des Batignolles 75017 PARIS - FRANCE or by sending an e-mail through the “contact” form of the site.

The data collected will be processed for the purpose of sending out a newsletter and/or processing the Customer’s order. The recipients of the data are the Vendor and its service providers.

The Customer has the right to access, change, correct and delete personal information concerning them by contacting the Vendor by emailthrough the “contact” form of the site.

 Elixirs & Co may place a cookie in the visitor's computer, enabling identification. Visitors are reminded that they may oppose the placing of cookies by disabling this option in their browser navigator.

 

12. Intelllectual property


In accordance with legislation governing the ownership of literary and artistic rights, or other similar rights, this Site and all the elements, brands, drawings, models, photographs, texts, illustrations, logos, graphics, etc., to be found in this site, are the exclusive property of the Vendor, as it does not grant any license or any entitlement other than that of consulting the Site.

Any use or reproduction constitutes infringement.               

 

13. Applicable law


The sales of products of the Vendor are subject to French law.
